3,173. The Sixth Gift for the Needy

Hilchos Matnos Aniyim 5:27

Let’s say that someone declares his vineyard ownerless (hefker), then he gets up, acquires the vineyard for himself and harvests it. In such a case he is obligated in the gifts for the needy – peret, olelos, shich’cha and peah. This is because it still fits the Torah parameters of “your field” and “your vineyard” in that it was his before and it’s his now. However, if he acquired a field that belonged to someone else and was declared ownerless, then he’s exempt from leaving these gifts. In all of these cases, however, he is exempt from the tithes, as we will see IY”H in Hilchos T’rumos.

Hilchos Matnos Aniyim 6:1

A sixth gift (in addition to the above four, plus leket) is given to the needy from the produce of the land: the tithe for the needy (maaser ani).
