3,161. Intending to Bring a Sheaf, Then Forgetting It

If the needy stand in front of a sheaf or cover it with straw and the landowner remembers the straw, or if the landowner took hold of the sheaf in order to bring it to the city but he left it in the field and forgot about it, it’s not shich’cha. However, if he moved the sheaf from one place to another and subsequently forgot it, it is shich’cha. This is the case even if he left it near a landmark like a gate, a pile of grain, cattle or tools.

Let’s say that the landowner took a sheaf intending to bring it to the city. He put it down on another sheaf and subsequently forgot about both of them. If he remembers the top sheaf before he sees it, the bottom one isn’t shich’cha; otherwise, it is.
