3,160. Shich'cha

Hilchos Matnos Aniyim 5:1

A sheaf is not considered shich’cha (forgotten) if it was forgotten by the farmhands but not the landowner, if it was forgotten by the landowner but not the farmhands, or if it was forgotten by both the landowner and the farmhands but there were passersby who saw it when they forgot it. Shich’cha must be forgotten by everyone. Even a sheaf that was hidden away is shich’cha if it’s forgotten.

Hilchos Matnos Aniyim 5:2

Let’s say that a landowner is in the city. He says that he knows that his workers forgot a sheaf in certain place. Later, he himself forgets it. In such a case, the sheaf is shich’cha. If he was in the field and made that statement, after which he forgot about the sheaf, it’s not shich’cha. This is because in a field only a sheaf that is forgotten initially is shich’cha, while in the city even a sheaf that is remembered and subsequently forgotten is shich’cha. This is derived from Deuteronomy 24:19: “If you forget a sheaf in the field,” as opposed to in the city.
